Terms & Conditions
By booking a trip with Atlas Trek Guide, you (the “Lead Client”) agree to these terms on behalf of yourself and all members of your party.
1. Booking & The Contract
-
The Contract: A binding contract is formed once we receive your deposit and issue a formal booking confirmation and invoice.
-
The Lead Client: The person named on the booking is responsible for all payments and for ensuring all party members are aware of these terms.
-
Accuracy: You must provide names exactly as they appear on passports. Any costs arising from incorrect information (e.g., permits for Mt. Toubkal) are the client’s responsibility.
2. Payment Schedule
-
Deposit: A non-refundable deposit of 30% is required to secure your trek.
-
Final Balance: The remaining 70% is due 30 days before the start of the trip.
-
Late Bookings: For bookings made within 30 days of departure, 100% payment is required immediately.
-
Price Lock: Once your deposit is paid, the price of your trek is guaranteed and will not change, regardless of currency fluctuations.
3. Cancellation Policy
Cancellations must be sent in writing to [Your Email]. The following fees apply based on the date received:
-
60+ days before departure: Loss of deposit only.
-
31 – 59 days before departure: 50% of total trip cost.
-
30 days or less before departure: 100% of total trip cost (no refund).
4. Mandatory Trekking Insurance
Trekking in the High Atlas Mountains involves inherent risks. It is a strict condition of booking that all participants have comprehensive travel insurance.
-
Required Coverage: Your policy must cover “High Altitude Trekking” (up to 4,167m for Toubkal), emergency medical expenses, and helicopter evacuation.
-
Refusal of Service: We reserve the right to cancel your trek on the start date—without refund—if you cannot provide proof of adequate insurance.
5. Health, Fitness, and Safety
-
Participant Responsibility: You acknowledge that trekking is physically demanding. You certify that you do not have any medical conditions that would make the activity dangerous for you or the group.
-
Guide Authority: Our guides are certified professionals. Their decision regarding the route, weather safety, or a participant’s ability to continue (due to altitude sickness or exhaustion) is final and absolute.
-
Medical Disclosure: You must notify us of any allergies (especially food allergies) or chronic conditions at the time of booking.
6. Itinerary Flexibility & Force Majeure
-
Mountain Conditions: We reserve the right to alter routes or accommodations due to weather, landslides, or government safety warnings. No refunds are given for such changes.
-
Force Majeure: Atlas Trek Guide is not liable for failures caused by “Acts of God,” war, strikes, pandemics, or natural disasters. In such cases, we will attempt to offer a credit for a future trip.
7. Responsibility & Liability
-
Limitation of Liability: We act as an agent for local transport, guesthouses, and muleteers. While we choose our partners carefully, we are not liable for the acts or omissions of these third parties.
-
Personal Property: We are not responsible for damage to or loss of personal items (cameras, phones, drones) during transport or while carried by mules.
8. Local Laws & Cultural Etiquette
-
Respect: We operate in the traditional homelands of the Amazigh (Berber) people. Clients are expected to dress modestly in villages and respect local customs.
-
Illegal Acts: Possession of illegal drugs or any behavior that endangers the group’s welfare will result in immediate expulsion from the trek without refund.
9. Governing Law
This contract is governed by the laws of the Kingdom of Morocco. Any legal disputes shall be settled exclusively in the courts of Morocco.
